List Serve - Rules, Policies and Disclaimers

The purpose of the list server is to provide a forum for MidasPlus clients for the sharing of ideas, concepts, methods, problems, solutions and other thoughts related to MidasPlus’ products and services. Use of the list server for personal or any reason other than that stated above is strictly prohibited.

Considering the nature of the list server, it is impossible for us to review messages or confirm the validity of information posted. The list server is provided “as is”, with no warranties of any kind from MidasPlus or ACS. We are not responsible for the content of any messages posted, nor for the lack of timeliness, failure to post, inaccessibility or deletion of any message. While MidasPlus or ACS staff may periodically participate in the lists, do not rely on the list server as a substitute for contacting MIDAS+ Customer Support. If you participate in the list server and use the information provided, without confirming the information you use with MIDAS+ Customer Support, you do so at your own risk.

MidasPlus and ACS do not vouch for or warrant the accuracy, completeness or usefulness of any message. The messages express the views of the author of the message, not the views of MidasPlus or ACS. MidasPlus and ACS reserve the right to delete any message for any or no reason whatsoever. Any user who feels that a posted message is offensive is encouraged to contact midas.webmaster@acs-inc.com immediately by email. We will make every effort to delete an offending message within a reasonable time frame, if we determine that removal is necessary. This is a manual process, however, so please realize that we may not be able to remove or edit particular messages immediately. Any user posting a message that MidasPlus determines to be offensive will be denied any further access to the list server and, if MidasPlus chooses, the MIDAS+ Clients Only website. Further, MidasPlus may choose to take legal action against any user posting any message that MidasPlus determines is offensive.

You agree, through your use of this service, that you will not use the list server to post any material which is knowingly false and/or offensive, which includes but is not limited to, defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or that otherwise violates any law. You agree not to post any copyrighted material of any kind. You understand that your use of the list server reveals your identity to others and therefore no right of privacy is provided to you by its use. You agree to treat your access to this list sever as confidential and to protect it from disclosure. You agree never to post any patient identifiable information on the list server. MidasPlus and ACS reserve the right to reveal your identity (or whatever information we know about you) in the event of a complaint or legal action arising from any message posted by you. You understand that advertisements, chain letters, pyramid schemes, and solicitations are inappropriate on the list server.

You agree to waive any ownership rights of any kind to any ideas, concepts, techniques, methods, processes or similar information posted by you on the list server. You understand that MidasPlus and ACS may use the information you post on the list server to enhance, develop and or expand its products and services and agree that if MidasPlus or ACS chooses to utilize your information, you have no rights of any kind in MidasPlus’ or ACS' use thereof.

YOU UNDERSTAND THAT YOU ARE SOLELY LIABLE FOR THE CONTENT OF YOUR MESSAGES AND YOUR USE OF INFORMATION POSTED ON THE LIST SERVER. YOU UNDERSTAND THAT NEITHER MIDASPLUS NOR ACS IS RESPONSIBLE, IN ANY MANNER, FOR ANY COMMUNICATIONS OR ACTIVITIES THAT RESULT FROM YOUR REVEALING YOUR IDENTITY TO OTHERS THROUGH THIS LIST SERVER. YOU UNDERSTAND THAT MIDASPLUS AND ACS PROVIDE NO WARRANTIES AND HAVE NO LIABILITY OF ANY KIND TO YOU OR ANY THIRD PARTY FOR THE CONTENT OF MESSAGES POSTED ON THE LIST SERVER AND YOUR ACCESS TO OR USE THEREOF. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS MIDASPLUS AND ACS AND THEIR AGENTS WITH RESPECT TO ANY CLAIM ARISING OUT OF YOUR BREACH OF THESE RULES. YOU AGREE THAT ANY ACTION PURSUED BY EITHER YOU OR MIDASPLUS OR ACS TO ENFORCE OR DEFEND ANY RIGHT HEREUNDER WILL BE PURSUED IN THE COURTS AND UNDER THE LAW OF THE STATE OF TEXAS. YOU UNDERSTAND THAT MIDASPLUS OR ACS CAN TERMINATE YOUR RIGHT TO USE THE LIST SERVER OR MODIFY THE TERMS RELATING TO ITS USE, AT ANY TIME.
